Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the IEP Right mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and IEP Right LLC ("IEP Right," "we," "us," or "our"). We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the App after the effective date of any change constitutes acceptance of the updated Terms.

2. Who Can Use IEP Right

You must be at least 18 years of age to create an account. By using the App, you represent that you are the parent, legal guardian, or other legally authorized representative of the child whose IEP information you enter, and that you are using the App for lawful purposes only.

3. Description of the Service

IEP Right provides tools to help parents and guardians of children with disabilities: track daily IEP accommodation compliance, maintain an observation journal, manage IEP-related deadlines and receive reminders, prepare for IEP meetings, access educational information about rights under IDEA and applicable state law, and connect with other parents in a moderated community.

4. Not Legal Advice

THE INFORMATION PROVIDED IN IEP RIGHT — INCLUDING THE IDEA RIGHTS CONTENT, MEETING PREP SUMMARIES, SUGGESTED TALKING POINTS, AND ALL OTHER FEATURES — IS FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY. IT IS NOT LEGAL ADVICE AND DOES NOT CREATE AN ATTORNEY-CLIENT RELATIONSHIP.

If you have a legal dispute with your school district, are considering filing a due process complaint, or need advice specific to your child's situation, consult a licensed special education attorney or advocate in your state.

5. Account Registration and Security

You agree to provide accurate, complete, and current information when creating your account, maintain the security of your password, and notify us immediately at support@iepright.com if you suspect unauthorized access. You are responsible for all activity that occurs under your account.

6. Subscriptions and Payment

Free Tier: Available at no cost. Includes core compliance tracking, deadlines, observation journal, IDEA rights content, and community access.

Paid Subscriptions: Processed through the Apple App Store or Google Play Store. All billing, refunds, and subscription management are governed by Apple's or Google's terms. We do not have access to your payment information.

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. Manage your subscription in your App Store or Google Play account settings.

7. Community Guidelines

By participating in the IEP Right community, you agree to be respectful and supportive of other parents and to post only content relevant to IEP and special education topics. You agree not to post hateful, harassing, or abusive content; identify school employees or other students in a way that could harm them; post personal identifying information; or post spam or advertisements.

Community posts are anonymous. Only your state badge is shown. Community content is for informational purposes only and does not constitute legal advice.

8. Your Content

You retain ownership of the content you create in IEP Right. By posting content in the community, you grant us a non-exclusive, royalty-free, worldwide license to display and distribute that content within the App for other users to see.

9. Prohibited Uses

You agree not to use the App for any unlawful purpose, attempt to gain unauthorized access to any part of the App, reverse engineer or decompile the App, use automated tools to extract data, or interfere with the operation of the App.

10. Intellectual Property

All content in the App that we created — including the app design, IDEA rights content, interface text, graphics, and features — is owned by IEP Right LLC and is protected by copyright and other intellectual property laws. The underlying legal text of IDEA and California Education Code is in the public domain; our plain-language descriptions are original works owned by IEP Right.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IEP law changes over time. While we aim to keep rights content accurate, we make no guarantee that it reflects the most current law.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IEP RIGHT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless IEP Right LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the App, your violation of these Terms, or content you post in the community.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California. Before filing any formal legal claim, you agree to contact us at support@iepright.com and attempt to resolve the dispute informally for at least 30 days. Any legal action shall be brought exclusively in the state or federal courts located in Stanislaus County, California.

15. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting us at support@iepright.com. Upon termination, we will delete your personal data within 30 days, subject to our data retention obligations.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email at least 30 days before the effective date.
